Med4Home Ships Tainted Medications to 19,000 Patients

A Med 4 Home pharmacy in Kansas City, Mo., notified more than 19,000 patients nationwide that it was recalling respiratory drugs in 2003 after state regulators found bacterial contamination. While there are many exceptions available as described in the Stark Law, the exception that applies most commonly to skilled nursing facilities is the "personal services exemption." To meet the requirements of the personal services exemption, and to qualify for protection under a safe harbor, the nursing home and the physician must satisfy several key conditions.

 
History

E-Health Solve, Inc. and Convergent Media Network, Ltd. entered into a software and services contract with, Soporex, Inc. a Delaware corporation operated out of Dallas.  This is a completely different company than the Lincare/Med4Home purchase was conducted with.  E-Health and Convergent with Busienss Associates under these contracts, and provided communication and software services for patients and hosted all of the technology necessary for the Soporex, Inc. business.
